Terms of Service

Important: These Terms constitute a legally binding agreement between you and Merak (the developer), not between you and Apple Inc. Please read them carefully before using the app.
1. Acceptance of Terms
By downloading, installing, or using Merak ("the App" or "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the App.
These Terms supplement, and do not replace, the Apple Licensed Application End User License Agreement ("Apple EULA"). In the event of a conflict between these Terms and the Apple EULA, the Apple EULA shall prevail to the extent of the conflict.
2. Description of Service
Merak is a structured learning app that helps users turn topics into paths, practice with real questions, and track progress through short learning sessions. The App provides:
- A curated library of learning paths across diverse topics
- The ability to create custom courses using AI-powered content generation. Merak Pro includes four custom courses per subscription period; every tier earns one custom course by completing a course, at most one per account per UTC calendar month. Learning points are a record of progress and are never spent. Generation remains subject to reasonable abuse prevention, safety review, and temporary service-capacity controls
- Quiz-based learning with multiple question formats
- Progress tracking, completion history, points, and milestone features
- Personal progress systems that help users continue paths without requiring endless sessions
3. License Grant and Restrictions
3.1 License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device you own or control, as permitted by the Apple App Store Terms of Service and the Usage Rules set forth therein.
3.2 Restrictions
You may NOT:
- Copy, modify, reverse engineer, decompile, or disassemble the App or any part thereof
- Rent, lease, lend, sell, redistribute, or sublicense the App
- Use the App for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to our systems or other users' data
- Use automated tools, bots, or scripts to access the Service
- Share your account credentials with others
- Circumvent any security or access control measures
4. User Accounts
4.1 Account Creation
- You may use Merak as a guest, or create a full account with Sign in with Apple or Google Sign-In
- You must provide accurate information when creating an account
- You are responsible for maintaining the security of your account
4.2 Age Requirements
- You must be at least 13 years old to use Merak.
- If you are under 18, you may use Merak only with the permission of a parent or guardian, and that parent or guardian accepts these Terms on your behalf. Where the law of your country requires a parent or guardian to consent before a person of your age may use a service like Merak, that consent is required.
- Merak asks you to confirm that you meet the age requirement. Merak does not collect a date of birth for this check.
- During the current controlled pilot, access is further restricted to people who confirm they are at least 18 years old. This restriction applies to the pilot only and will be removed at public release.
4.3 Account Termination
- You may delete your account at any time through Settings → Account → Delete Account when signed in, or request deletion through support
- We reserve the right to suspend or terminate accounts that violate these Terms
- Upon deletion, your data is permanently removed in accordance with our Privacy Policy
5. Learning Models and Content Quality
Learning content in Merak is generated by AI. Every path, card, question, and review moment is produced by artificial-intelligence models and then passed through automated quality checks before it reaches the app. Human review is targeted rather than universal, so not all content has been read by a person before you see it.
5.1 How a path is built
A Merak path is not a single prompt to a chatbot. Each one is produced by a multi-stage generation pipeline in which every stage can reject the work of the one before it:
- Evidence first. Before any lesson text is written, Merak retrieves source material for the specific topic and fixes it as the evidence set for that build. Sourcing is weighted toward primary, academic, governmental, standards-body and professional references; social networks, forums and search-optimised aggregators are excluded in the request itself rather than filtered out afterwards.
- Claims are objects, not prose. The factual content of a path is planned as a ledger of individual claims before anything is written. Cards and questions are then rendered against those claims, so a fact cannot quietly change meaning between where it is taught and where it is tested.
- Grounding is checked, not assumed. Claims that are supposed to rest on retrieved evidence are re-checked against that evidence set. Claims that fail are repaired, re-sourced, or dropped before publication.
- A jury, not a single model. Finished material is reviewed by two independent model families, neither of which wrote it, so no model both authors and approves its own work.
- Failures are surgical. When a check fails, Merak regenerates the specific card, question or claim that failed — not the whole course — and re-runs the checks against the replacement.
- Shape is verified before publication. Content is validated against the real constraints of the app's screens, so a path cannot ship in a form the app cannot present honestly.
- Runs are bounded and reproducible. Every build runs inside fixed time, call and cost limits and fails closed rather than degrading quietly. Runs are seeded and recorded, so a given build can be inspected after the fact.
None of this makes generated content infallible, and Merak does not claim that it does. It is designed to make failure visible and bounded rather than silent. Material that survives every stage can still be wrong.
5.2 Limits
- Content may be created, reviewed, repaired, restricted, or rejected before broader availability
- Human review is targeted. Higher-risk topics, release candidates, and new content formats may receive human review before broader availability.
- Quality is earned, not assumed. Content that fails review may be repaired, restricted, or rejected.
- Merak is an educational platform designed to build understanding and spark curiosity. Like all educational tools, it is not a substitute for licensed professional advice in areas such as health, finance, law, or mental health
- Health, medical and mental-health topics. Merak does not diagnose conditions, recommend or adjust treatment, or give medical advice, and its content is not written or reviewed by a clinician. If a path touches your health, or the health of someone you care for, speak to a qualified healthcare professional before acting on anything you read here, and do not delay or discontinue care because of something a path said. In an emergency, contact your local emergency service — not an app.
- Money and law. The same applies to financial, legal and tax topics: Merak explains ideas, it does not advise on your situation. Speak to a licensed professional before making a decision that affects you.
- We are committed to content accuracy, but no educational resource is infallible. If you encounter an issue, report it through Merak Support.
6. User-Generated Content
6.1 Content You Create
When you create a learning path, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your path content in connection with the Service. This enables other users to take paths you create.
6.2 Content Standards
You agree that any path you create will not contain content that is:
- Illegal, harmful, threatening, abusive, or harassing
- Defamatory, obscene, or invasive of another's privacy
- Infringing on intellectual property rights of any party
- Deliberately false, misleading, or designed to cause harm
We reserve the right to remove any user-generated content at our sole discretion.
6.3 Feedback
Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to you.
7. Intellectual Property
7.1 Our Property
Merak, its logo, learning models, and all app content (including generated questions, cards, curriculum structures, and design elements) are the property of Merak and are protected by intellectual property laws. All rights not expressly granted are reserved.
7.2 Your Data
You retain ownership of your personal data. See our Privacy Policy for details on how we handle it.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which describes what data we collect, how we use it, and your rights regarding your data. By using the App, you consent to the practices described therein.
9. Payment Terms
Some Merak features are free. Merak may also offer paid subscriptions, including Merak Pro, through Apple App Store in-app purchase.
Merak Pro includes four custom courses in each subscription period. The allowance resets when the subscription renews and does not carry over between periods. Generation may be queued or temporarily delayed to protect service reliability, content quality, safety, and fair use. Courses already started remain finishable after a subscription ends.
Current controlled-pilot exception: payments and subscriptions are disabled. Merak Pro is not for sale in this release. Any Pro capability shown to invited testers is a no-charge preview and does not create a subscription. Future paid availability requires a separate release decision and the in-app App Store terms shown at that time.
Subscription prices, billing periods, renewals, cancellations, and refunds are handled by Apple and are subject to Apple's payment terms and App Store policies.
10. Disclaimers
10.1 "As Is" Service
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 Service Availability
- We strive for high availability but do not guarantee uninterrupted service
- We may modify, suspend, or discontinue features at any time
- We are not liable for data loss or service interruptions
10.3 Educational Content
- Merak is an educational platform: our content is designed to build real understanding
- Like all educational resources, specific learning outcomes depend on individual effort and engagement
- Content covering health, finance, law, or similar domains is educational in nature and does not replace licensed professional advice
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability to you for any claims arising from or relating to these Terms or your use of the App shall not exceed the total amount you have paid us in the twelve (12) months preceding the claim, or fifty US dollars ($50), whichever is greater
- We are not responsible for third-party services, content, or actions
12. Indemnification
You agree to indemnify, defend, and hold harmless Merak and its developers, officers, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.
13. Maintenance and Support
Merak (the developer) is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support services with respect to the App.

14. Warranty
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty shall be the sole responsibility of Merak (the developer).
15. Product Claims
Merak (the developer), not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to:
- Product liability claims
- Any claim that the App fails to conform to any applicable legal or regulatory requirement
- Claims arising under consumer protection, privacy, or similar legislation
16. Intellectual Property Claims
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Merak (the developer), not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
17. Legal Compliance
You represent and warrant that:
- You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
- You are not listed on any U.S. Government list of prohibited or restricted parties
18. Third-Party Terms
You must comply with applicable third-party terms of agreement when using the App, including your wireless data service agreement.
19. Apple as Third-Party Beneficiary
You acknowledge and agree that Apple Inc., and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

21. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms shall be resolved through good-faith negotiation. If a resolution cannot be reached within thirty (30) days, the dispute shall be submitted to the exclusive jurisdiction of the courts of Istanbul, Turkey.
22. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
23. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, or force majeure events.
24. Changes to Terms
- We may update these Terms at any time
- Continued use after changes constitutes acceptance
- We will notify you of material changes via email or in-app notification
- The "Last Updated" date at the top reflects the most recent revision
